1. Introduction

Welcome to My Influencer ("App"), published by Reaspect - Gökhan Perçem ("we," "us," or "our"). By downloading, accessing, or using My Influencer, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

My Influencer is an AI-powered content creation application that enables users to:

  • Design and customize AI-generated avatars and influencer personas.
  • Generate short-form videos optimized for social media platforms (e.g., Instagram Reels, TikTok, YouTube Shorts).
  • Create image posts, story graphics, and other social media assets using AI models.
  • Access premium AI styles and models through a subscription plan.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. Users between 13 and 18 must have parental or guardian consent.

4. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your login credentials confidential and not share your account with others.
  • Notify us immediately at our Support Page if you suspect unauthorized access to your account.
  • Be responsible for all activities that occur under your account.

5. Subscriptions and Payments

5.1. Free and Premium Tiers

The App may offer a free tier with limited features and one or more paid subscription plans providing access to advanced AI models, higher generation limits, and premium content styles.

5.2. Billing

Subscriptions are billed through Apple's App Store (In-App Purchases). By subscribing, you authorize Apple to charge your payment method on a recurring basis for the applicable subscription period (monthly or annual).

5.3. Renewals and Cancellations

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You may cancel at any time through your iOS Settings > [Your Name] > Subscriptions. Cancellation takes effect at the end of the current paid period; no partial refunds are issued for unused time.

5.4. Refunds

Refund requests are handled by Apple in accordance with their App Store refund policy. We do not control or process refunds directly.

6. User-Generated Content and AI Outputs

6.1. Your Inputs

You retain ownership of any text prompts, preferences, or other inputs you provide to the App.

6.2. AI-Generated Outputs

You own the content generated from your inputs ("Outputs"), subject to the following conditions:

  • Outputs may not be used for any unlawful purpose or in violation of any third-party rights.
  • You are solely responsible for how you use, publish, or distribute Outputs.
  • We reserve a limited, non-exclusive, royalty-free license to store and serve your Outputs solely for providing the App's functionality to you.

6.3. Prohibited Content

You agree not to use the App to generate content that:

  • Depicts or promotes violence, hate speech, discrimination, or illegal activities.
  • Infringes on the intellectual property, privacy, or likeness rights of any person or entity.
  • Constitutes misinformation, deepfakes intended to deceive, or non-consensual intimate imagery.
  • Violates the guidelines or Terms of Service of any social media platform to which you publish content.

7. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the App.
  • Use automated means (bots, scrapers) to access or interact with the App.
  • Attempt to circumvent subscription restrictions or access premium features without payment.
  • Interfere with or disrupt the App's servers, networks, or infrastructure.
  • Impersonate any real person or entity without their explicit consent when publishing AI-generated content.

8. Intellectual Property

All rights, title, and interest in and to the App — including its design, code, branding, and AI models — are and remain the exclusive property of Reaspect - Gökhan Perçem. Nothing in these Terms grants you any rights to use our trademarks, logos, or brand identifiers.

9. Third-Party Services and Platforms

The App uses third-party AI services and may facilitate publishing to third-party social media platforms. We are not responsible for the availability, policies, or actions of those platforms. Your use of social media platforms is governed by their own terms of service.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL MEET YOUR EXPECTATIONS OR BE FREE FROM INACCURACIES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REASPECT - GÖKHAN PERÇEM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Termination

We reserve the right to suspend or terminate your account at any time, without prior notice, if you violate these Terms or engage in conduct we determine to be harmful to other users, third parties, or us. Upon termination, your right to use the App ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date above and, where appropriate, providing an in-app notice. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
